01Who these terms are for
These terms apply to you if you use NetFit inSession as a gym member (iOS, Android or web app) or as gym staff (the “NetFit inSession Gym” app or the web app). By creating an account and accepting these terms in the app, you agree to them.
They do not replace the separate contract between a gym and NetFit, or the agreement between you and your gym about your membership.
Provider of the software: NetFit, [NetFit legal entity name, registered address and company number - to be completed]
02What the service is
NetFit inSession is gym management software with a member portal. Gyms use it to run classes, bookings, memberships and check-ins. Members use it to book, check in and follow their own training. It is available as a member app (iOS, Android and the web at app.insession.netfit.coach) and as a staff app and web app (insession.netfit.coach).
03Accounts and security
- Give correct information and keep it up to date.
- You must be 16 or older, or have a parent or guardian agree on your behalf.
- Keep your sign-in details to yourself. Do not let anyone else use your account.
- Tell us or your gym straight away if you think someone else has access to your account.
- You are responsible for what happens under your account, unless it happened because of a fault on our side.
- If you forget your password, ask your gym administrator for a reset link.
04Acceptable use
Please use the service fairly. You must not:
- break the law, or help someone else to break it, through the service;
- try to get into someone else’s account or into data you are not allowed to see;
- interfere with the service or its security, or try to get around its limits and protections;
- upload content that is unlawful, harmful, or that you have no right to share;
- harass or threaten other people through the service;
- (staff) use members’ personal data for anything other than providing the gym’s services.
05What the gym is responsible for, and what NetFit is
| Who | Responsible for |
|---|---|
| Your gym | Classes, memberships, fees and payments, trainers, the premises, opening hours, and its own rules such as booking windows and cancellation cut-offs. |
| NetFit | The software: providing the apps, keeping them running and keeping your data in them secure. |
NetFit is not a party to your membership with the gym. For questions about your membership, billing, class times or trainers, please contact your gym.
06Health notice
Workouts, exercises and other training content in the app are general information. They are not medical advice. Talk to a doctor before you start or change a training programme, especially if you have a health condition, are pregnant, or are returning from an injury. Stop exercising and get help if you feel pain, dizziness or unwell. You are responsible for deciding what is safe for you.
07Your content and photos
The content you add, such as your workout logs, measurements and progress photos, remains yours. You give NetFit a limited licence to store, process and display it only so that we can run the service for you and your gym. Progress photos stay private to you unless you share them with a trainer.
You are responsible for having the right to upload what you upload. You can delete your content, or your whole account, at any time (see Delete account). How we handle personal data is explained in the Privacy policy.
08Availability and changes to the service
We work to keep the service available, but we cannot promise that it will always be uninterrupted or free of errors. We may carry out maintenance, and we may change, add or remove features. If a change affects you in a major way, we will try to tell you in advance.
09Suspension and ending your use
We, or your gym, may suspend or close an account if these terms are broken, if the account is a security risk, or if the law requires it. You can stop using the service and delete your account at any time.
10Intellectual property
The software, the NetFit and NetFit inSession names and logos, and the design of the apps belong to NetFit or its licensors. You receive a personal, non-exclusive, non-transferable right to use the apps for the purpose described in these terms. You may not copy, sell or reverse-engineer the software, except where the law allows it.
11Disclaimer and limit of liability
The service is provided “as is” and “as available”. To the extent the law allows, NetFit is not liable for indirect or consequential loss, for loss that was not reasonably foreseeable, or for the services, decisions or conduct of your gym or its trainers.
Nothing in these terms limits liability that cannot be limited by law, such as liability for intent, fraud, or death or personal injury caused by negligence. Your rights as a consumer are not affected.
12Governing law
These terms are governed by the law of the Republic of North Macedonia. The competent courts of the Republic of North Macedonia decide disputes, to the extent the law allows. Mandatory consumer-protection rules of the country where you live remain unaffected.
13Changes to these terms
We may update these terms. The “last updated” date at the top shows the current version. When we make a change, we will tell you, and the app asks you to review and accept the updated terms before you continue. If you do not agree, you can stop using the service and delete your account.
